Article 2 – Subject

This Distance Sales Agreement determines the rights and obligations of the parties regarding the sale and delivery of the product(s) ordered electronically by the BUYER through the website https://squishyswagg.com, in accordance with the Law on the Protection of Consumers No. 6502 and the Regulation on Distance Contracts.

By confirming this Agreement electronically, the BUYER accepts that they have been informed clearly and accurately about the Seller’s name, address, product details, price including taxes, payment and delivery terms, and the right of withdrawal.


Article 3 – Product / Payment / Delivery Information

The type, model, quantity, sales price, payment method, delivery address, and shipping fee of the ordered product(s) are stated in the electronic order form and invoice, which are integral parts of this Agreement.

The BUYER agrees that the provided information is accurate and complete. If incorrect or incomplete information causes any loss or delay, the BUYER accepts full responsibility.


Article 4 – Force Majeure

Events such as natural disasters, war, terrorism, strike, fire, government restrictions, or other unforeseen circumstances that prevent either party from fulfilling their obligations will be considered force majeure.
In such cases, the affected party must immediately inform the other.
If the situation continues for more than 30 days, either party may terminate the contract without compensation.


Article 5 – Seller’s Obligations

The SELLER undertakes to fulfill all obligations under this Agreement except in cases of force majeure.
Persons under 18 years old cannot place orders on the website.
The SELLER is not responsible for system errors or price inaccuracies caused by illegal interventions or technical problems on the website.


Article 6 – Buyer’s Obligations

The BUYER accepts the provisions of this Agreement and agrees to make payment according to the selected payment method.
The BUYER also declares that they have read and confirmed all pre-information forms, usage instructions, and return conditions before placing the order.

The BUYER agrees not to damage the product or its packaging when returning it and to send the original invoice and delivery note with the return.


Article 7 – Order, Payment & Delivery Procedure

Orders are confirmed only after payment is successfully received by the SELLER.
Payment can be made by credit card or bank transfer (EFT).
Once the order confirmation e-mail is sent, the product(s) will be shipped through the SELLER’s contracted cargo company.

If the ordered product cannot be supplied, the BUYER will be informed immediately and offered an alternative of equal quality and price, or the order may be cancelled and refunded.

Delivery time is up to 30 business days after order confirmation, excluding force majeure or carrier delays.


Article 8 – Right of Withdrawal & Returns

The BUYER has the right to withdraw from the contract within 7 days of receiving the product, without any justification and without penalty.
To use this right, the BUYER must contact the SELLER via e-mail and return the product unused, undamaged, and in its original packaging along with the invoice.

Products specially made or customized for the BUYER (such as made-to-order clothing) cannot be returned unless defective.

If the return is approved, the refund will be processed within 10 business days to the original payment method.

Shipping costs for returns belong to the BUYER.


Article 9 – Warranty

All products are guaranteed for 2 years against manufacturing defects, provided they are used according to care instructions.
This warranty does not cover wear and tear, misuse, or washing damage.


Article 10 – Confidentiality

The SELLER will not share BUYER’s personal information with third parties except where legally required.
Credit card information is never stored and is used only for secure payment authorization.


Article 11 – Dispute Resolution

In case of disputes, the Consumer Arbitration Committees or Consumer Courts in the Buyer’s or Seller’s jurisdiction will be authorized as per applicable law.


By confirming the order, the BUYER acknowledges that they have read and accepted all the terms of this Distance Sales Agreement.
